Patrick Emery


Patrick is a seasoned trial and appellate attorney who efficiently handles matters for individual and corporate clients in federal courts, state courts, and arbitrations across the country. He focuses on the client’s business and personal goals, provides excellent client service, and drives matters to successful resolution. Over the years, Patrick has helped clients recover hundreds of millions of dollars and avoid billions of dollars in exposure. In-house counsel and business clients retain Patrick because they want an effective attorney with more than a decade of “big law” experience who can handle complex cases, but don’t want to pay “big law” rates.

Patrick is an expert in commercial and class action litigation for car rental companies, manufacturers/distributors, financial services, energy companies, and other enterprises. Representative cases include disputes involving contracts (sales of goods, asset purchases, lending, commissions), business torts (fraud / tortious interference / unfair competition), restrictive covenants (non-complete / non-solicitation / non-disclosure agreements), consumer protection laws (unfair and deceptive practices / fraud / misrepresentation), healthcare provider reimbursements, fiduciary duties, trust indentures, injunctions, and enforcement of arbitration agreements and awards. Patrick has litigated numerous class actions involving consumer contracts, arbitrability issues, trust indenture agreements, and Ponzi or pyramid schemes. Patrick tailors his litigation strategy to the value and objectives of each case to reduce the time, costs, and other resources expended on e‑discovery, depositions, written discovery, and dispositive motions.

In his healthcare litigation practice, Patrick defends health plans, patients / plan members, and plan administrators against balance bill claims brought by medical providers and debt collectors, and protects patient rights under consumer protection laws, deceptive trade practices laws, the Fair Debt Collection Practices Act (FDCPA), and the Fair Credit Reporting Act (FCRA).

Patrick also assists corporate clients by advising on litigation and regulatory risks associated with their business dealings, developing and enforcing consumer arbitration agreements, conducting internal investigations of employee fraud or other misconduct, responding to subpoenas, as well as drafting consumer and commercial contracts.
